A great number of federal and state environmental requirements are geared specifically toward regulation of the oil and gas industry. Many activities in the energy sector are subject to requirements of agencies other than the EPA or state environmental departments. In the mid-continent area, state oil and gas agencies such as the Oklahoma Corporation Commission operate environmental programs specific to the energy sector. Pipelines and other linear infrastructure projects and operations may be regulated by the Federal Energy Regulatory Commission if they are interstate in scope, but they still face many local permitting and compliance issues during both construction and operation.

In the sector of wind energy, developers and landowners face a number of challenges in negotiating wind project development and land-use transactions that are fair and sustainable.  Legislation in some states is being offered to try to regulate or resolve issues between landowners and wind developers, but state statutes cannot cover all the issues involved in negotiating sound agreements.

New and emerging issues revolving around climate change, greenhouse gas emissions, and carbon sequestration are not yet developed from a regulatory standpoint but may present both environmental challenges and commercial opportunities for clients.
