Mediation and Arbitration

An Alternative to Litigation in Court

Ninety-seven percent of all legal cases in Oklahoma never make it to trial. Alternative dispute resolution techniques such as mediation and arbitration provide a less costly and less time-consuming alternative to litigation in court.

Doerner Saunders Daniel & Anderson attorneys serve as mediators and arbitrators in cases in both state and federal court, in Oklahoma and across the United States. Our mediators perform shuttle diplomacy to negotiate common ground between opposing parties. Our arbitrators sit as private judges, hear evidence from both sides, and then render an opinion. Arbitration is usually binding, while either side in a mediation case can walk away at any time.

Mediation and arbitration can be used in a wide variety of business and other civil law matters, including:

  • Complex commercial litigation
  • Personal injury and products liability
  • Health care and ERISA issues
  • Bankruptcy
  • Family law, divorce and child custody cases
  • Insurance coverage issues
  • Construction disputes
  • Employment and labor cases
  • Peer review for health care professionals

Many of our attorneys practicing as mediators and arbitrators have been appointed as adjunct settlement judges in the ADR program of the United States District Court for the Northern District of Oklahoma. Federal courts in Oklahoma require every case to go to mediation before it goes to trial.

Over twenty of our lawyers have been recognized by Best Lawyers in America, which is regarded as the preeminent referral guide to the legal profession in the United States.
