The Employer’s Legal Resource:  DOL Delays Implementation of Final Rule on Independent Contractors

In the February ELR, we told you that the U.S. Department of Labor had issued its final regulations regarding whether a worker should be classified as an employee or an independent contractor. The final rule was scheduled to take effect March 8, 2021, but the DOL has announced it will delay the effective date 60 days, until May 7, 2021, to allow additional opportunity for review and consideration of the rule under the new Biden administration (the final rule was issued before President Trump left office). We will keep you posted with any substantive changes.
