Marriage Rights

Oklahoma’s journey regarding LGBTQ+ families and same-sex marriage rights has been a complex one. In 2004, the state banned same-sex marriage through a constitutional amendment. It defined marriage as between one man and one woman.

However, in 2014, a federal court ruled this ban unconstitutional. This paved the way for legal same-sex marriages in Oklahoma. However, there was still resistance from some officials who refused to issue marriage licenses to same-sex couples.

This led to further legal battles until the United States Supreme Court’s landmark ruling in Obergefell v. Hodges in 2015 legalized same-sex marriage nationwide, including in Oklahoma.

LGBTQ+ Adoption Laws

In terms of adoption rights, many states now allow same-sex couples to adopt children jointly. This shift marks a positive change towards acknowledging that love and stability are what truly define a family, regardless of sexual orientation or gender identity.

Because of these laws, around 4% of adopted children are now being raised by same-sex couples. Same-sex couples are permitted to adopt in Oklahoma.

Adoption rights for LGBTQ+ families in Oklahoma have progressed positively. However, there are still challenges. In 2018, Senate Bill 1140 was signed by Gov. Mary Fallin. This bill allows private adoption agencies to deny applicants based on religious or moral reasons.
