Kaylee Davis-Maddy is a reputable trial lawyer in the commercial, healthcare, environmental and water law sectors.
Although primarily a litigator, Kaylee’s practice is full service—assisting her clients and their needs that span the employment, commercial, real property, regulatory and administrative fields. Her healthcare practice includes advising physicians and other licensed providers regarding corporate, administrative and litigation issues, while her environmental practice focuses on interacting with state and federal agencies to provide her clients with the outcomes they desire. Most recently, Kaylee has obtained favorable results for clients in state and federal licensure and certification actions, including with the Department of Environmental Quality and Oklahoma State Board of Medical Licensure and Supervision.
Kaylee is an accomplished water attorney, regularly assisting clients in asserting, obtaining and protecting their water rights in court or at state agencies. Her clients include small and large municipalities, corporations, landowners and family farmers.
Kaylee is fluent in Spanish and proficient in American Sign Language. Outside the office, Kaylee dedicates her time to varying community groups, including being on the Board for the Women and Gender Studies Department at the University of Oklahoma.

- Assisted various entities in procuring Certificate of Need and state licensure for nursing facilities, assisted living facilities, and a hospital after change in ownership and to increase licensed beds.
- Obtained full dismissals on behalf of multiple physicians in licensure actions.
- Negotiated settlements on behalf of licensed medical professionals in licensure actions, and otherwise represented them in licensure investigations and enforcement actions at their requisite licensure boards.
- Represented healthcare entities (including independent providers, group practices, multi-practice clinics, and nursing facilities) in governmental and insurance investigations, audits, enforcement actions related to billing and coding issues, CDS claims, fraud and abuse. These include negotiating settlements, drafting Plans of Correction, and appearing for hearing and preparing appeals. These governmental agencies include CMS and the OIG/DOJ, the Oklahoma Department of Health, the Oklahoma Health Care Authority, Oklahoma Bureau of Narcotics and Dangerous Drugs, and the Drug Enforcement Administration (DEA).
- Represented various practices with respect to all aspects of compliance with Stark Law and federal anti-kickback statute compliance.
- Represented clients in creating clinical practices from start to finish, including drafting all necessary contracts and agreements, obtaining necessary governmental licensures.
- Assisted direct primary care practice, including creating the practice and advising on compliance issues.
- Advised healthcare entities on issues related to billing and reimbursement, privacy and security, staffing and provider compensation, corporate practice of medicine, employment concerns, and other regulatory compliance matters.
- Represented physicians in non-party matters, protecting their rights to avoid their inclusion as a potentially liable party.
- Represented nursing homes and nursing management companies in wrongful death, negligence, and malpractice actions.
- Represented healthcare management companies in contract disputes, fraudulent transfer actions, and tort claims.
- Represented physicians in various privileges actions, including medical staff suspensions.
- Advised physicians as it relates to National Practitioner Data Bank reports and possible reports, including responses and disputes related to the same.
- Reviewed and negotiated physician employment contracts and separation agreements.
- Represented inpatient psychiatric unit in involuntary commitment hearings and provided advice related to inpatient issues.
- Represented dry cleaners in federal CERCLA actions.
- Represented various entities in Oklahoma Department of Environmental Quality investigations, enforcement and adjudicatory actions/proceedings related to hazardous waste, solid waste and water/storm water.
- Represented parties in obtaining and protecting their groundwater and surface water permits at the Oklahoma Water Resources Board and in district courts, both as administrative hearings and APA appeals and civil litigation. This includes municipalities, companies, individuals and families.
- Represented well drillers in licensure matters and complaints, and parties making well drilling complaints.
- Represented clients in both making and defending against environmental complaints, including in civil litigation with matters related to nuisances, negligence, trespass, damage to property and personal injury from flooding and drainage claims, air emission issues, soil and groundwater contamination, and including agency matters at Oklahoma Department of Environmental Quality and Oklahoma Department of Agriculture.
- Negotiated sales of water, water permits and water use/licenses/access on behalf of both sellers and buyers.
- Represented company in disputing environmental and water ordinances related to nuisance determinations.
- Represented parties in Oklahoma Department of Mines matters, both on applicant and protestant sides.
- Advised clients with environmental compliance issues, including permitting and matters related to Oklahoma Department of Environmental Quality, Oklahoma Department of Mines, Oklahoma Department of Agriculture, and Oklahoma Water Resources Board.
